From OAMF: 1. There are NO requirements for the EPA to identify or regulate the chemicals used and contained in the discharge water like PFAS, Glycols and biocides. 2. There are NO requirements for current or future data centers to have on site water filtration systems to clean the discharge water of any harmful chemicals prior to discharge. 3. There are NO requirements for continuous monitoring of chemical levels in the cooling loops or testing for legionella in the cooling towers during peak months of concern (spring/fall). 3. It does remove non-disclosure agreements (sort of), but It’s still allows local governments to bypass the will of the citizens because there is NO vote required on the local ballot to approve the data center within 5 miles of the city, Villiage, or Township. 4. They are still allowing tax breaks up to 75%. 5. There are NO PENALTIES if the Data Center BREAKS the LAW. OAMF in collaboration with our chemical expert Stephen Petty, has legislation being drafted that will actually address the concerns of Ohio citizens and ensures regulatory oversight and compliance with the Law. Will the legislature adopt that language? Or will they force the citizens have to continue moving towards an outright ban that is supported by 70% of voters? The General Assembly could pass H.B. 646 as early as tomorrow. Lawmakers should correct shortfalls in the bill before approval for Governor DeWine's signature. We recently shared our recommendations here. As always, calling your representatives could still have a big impact. The sub bill made some positive changes, broadly described below. Note that despite progress, a lot more must be done to create comprehensive regulatory guardrails around data center development, and the effectiveness of many of these provisions hinges on OEPA & ODNR rule making authority, without specific stipulations amended into the bill. •Requires data center operators to implement water conservation measures, like closed-loop systems. •Requires OEPA to adopt rules around water quality & efficiency standards, regular reporting on/methodology for tracking water use. •Requires utilities to file data center tariffs with the PUCO, creating a separate rate class for data centers while preventing cost-shifting onto other customers. •Reduces sales tax exemption for most new projects from 100% to 50%, though we’ve been calling for a full repeal and this will not stop the exemption for those with existing agreements like Amazon, Google and Meta. At the same time, projects with onsite generation developed on brownfields would enjoy a 75% sales tax exemption, which has consequences for communities already facing undue environmental burdens from extractive industry, as data centers’ onsite generation is overwhelmingly fueled by fracked gas. •Fails to meaningfully address transparency & accountability concerns re NDA use and exemption of information about local economic development assistance from public records (O.R.C. Section 9.66).

Hospitals get billions in federally discounted drugs, and aren't required to pass a penny to patients. The Trump Administration is trying to fix with a rebate model that creates a paper trail proving the savings actually reach the poor. The hospital lobby sued to stop it. Transparency shouldn't stop reform it should drive it.
